Dave Feingold has been practicing real estate, common interest development, and construction law since 1986. His mediation practice is focused in these areas. His experience allows him to identify settlement opportunities and help parties locked in disputes find common ground. 

 

Mr. Feingold is very flexible and will work with the parties to conduct the process when and how the parties desire. More than ever, video conferencing is utilized for mediation sessions as experience has shown that conducting mediations remotely is both efficient and successful.

 

In person mediations can be conducted if desired and feasible, and Mr. Feingold has ample conference rooms available at his San Rafael offices.  If the parties prefer he will travel to a site more convenient for the parties and their counsel.

HOMEOWNERS ASSOCIATIONS:  Mr. Feingold is a recognized expert in common interest development law and and often publishes and speaks extensively at legal seminars state wide on the subject. He has significant experience in almost every imaginable dispute, from Davis Stirling compliance to high stakes enforcement actions. The majority of homeowner association disputes involve members locked in conflict with their own associations. These disputes are unique in two ways.  First, the dispute usually involves a member’s home, money, or family -- and sometimes all three. This is a volatile mix that requires careful handling. Second, the member and the Association typically will have a continuing relationship after the dispute is resolved. Crafting a settlement that results in a permanent resolution for the parties requires a deep knowledge of common interest development law as well as the political and practical realities of homeowner association living.   

 

REAL ESTATE:  Mr. Feingold has also litigated hundreds of cases involving disputes between neighbors, property line issues, non disclosure cases, disputes among co-owners, and many other disputes that involve the ownership and use of real property.  He brings that experience to bear to resolve conflicts that have escalated beyond the parties' control. 

 

CONSTRUCTION:   Mr. Feingold has considerable experience in drafting and enforcing construction contracts, licensing, and in prosecuting and defending disputes involving construction projects and construction defects.  He is known for his creative problem solving and helping parties resolve their disputes quickly and efficiently.  When that is not possible, he works toward putting in place a road map that will lead to resolution in an efficient and cost effective manner.
